 OUTSIDE EMPLOYMENT DURING A FURLOUGH/SHUTDOWN

I have received a large number of requests about the procedures for applying for outside employment (i.e. getting another job) during the shutdown/furlough.

I know may of you are experiencing a lot of stress due to the delay in receiving our retroactive pay. In an effort to provide information about that, I have included the section of the contract below in red text as to what happens in times like this. Normally, you have to submit the request for outside employment to your manager for approval BEFORE you start the job. However, the contract section below has a special provision. Please read it.

There is a point that needs clarification. The contract states Employees may not engage in any activity prohibited therein. What it means is that you cannot get a job doing the same thing as you do at IRS. So, you would not be able to work as a lawyer if you work in Counsel, or do accounting work (tax return prep, auditing of books, etc.) if you are a revenue agent or TCO, or any type of collection work if a Revenue Officer..

If you wanted to get a job as a salesperson at Macy's, for example, that would not be prohibited.

The contract does not list every occupation, as there are so many jobs out there, you could never cover them all.

Furlough Due to Lapse in Appropriations/Debt Ceiling Limitations

Article 48, Section 4

Requests for outside employment for any employment during the period of the furlough will be in accordance with the Plain Talk About Ethics and Conduct and Article 6, of this Agreement. Employees may not engage in any activity prohibited therein. While in a non-pay status, such employees may engage in outside employment without obtaining prior written permission that is otherwise required. Upon return to duty status, employees must submit a written request to engage in outside employment if such activity continues.
